On January 25, 2021, the proposed regulation, “Removing H-4 Dependent Spouses from the Class of Aliens Eligible for Employment Authorization” (commonly known as the “H-4 EAD Rescission Regulation”) was withdrawn from review at the Office of Information and Regulatory Affairs (“OIRA”). I would also like to mention here that my application won't fall under the AC21 act since my Greencard application won't be pending 365 days prior to my 6th year of my H-1B expiring on 12/10/2015.According to the reginfo.gov website, final rule for H4 EAD is approved by OMB with change on 2/13/2015 and the only thing left now is that USCIS H4 EAD rule making process is Complete. There was a huge response for this rule from the H-1B and H4 community.Highlights of Public Comments: USCIS has received a total of 12,835 comments H4 EAD provided a way for them to be employed and do something with their life. With this repeal, that option will be taken away.

It status says withdrawn and the OIRA concluded the OMB Review (EO 12866 Regulatory review) on Jan 25th, 2021. The withdraw status means that DHS does not plan to pursue the H4 EAD rule removal anymore. It is a big positive thing for H4 EAD holders.
